Large tree breaking through retaining wall in danger of falling

The cracks in the wall have become much larger in the last one to two years. The tree appears to be moving more in strong winds than it used to a few years ago. There is a great fear that this very large tree will fall and cause significant damage to the houses opposite and/or to passers by. The owner of the land is concerned that their insurance might not cover any such event because they are aware of the problem and it might be argued by their insurer that they have failed to take sufficient measures to mitigate the risk.

Please note that this tree could not be closer to the public highway. It is tight to the inside face of the retaining wall and the level of the ground within the site is over 1.0m higher than the level of the adjacent highway. This tree will fall at some point when the wind blows in the worst direction and at the necessary velocity. It is not a matter of "if" the tree will be blown over but "when" it will be blown over and the results will be, without question catastrophic.
