This tree is fairly new but was not in leaf in the spring and now appears to be completely dead.

I'm not sure this issue has been 'resolved' by your contractor simply cutting the top of the tree off and leaving the bottom half intact. Surely it will only really be resolved when a new tree is planted in this spot?

Thank you for your update. The tree will be replaced during the planting season which is October to April.
